Terms of Service

These Terms of Service ("Terms") govern your use of SharperPage at sharperpage.com (the "Service"), operated by Misback Consulting ("SharperPage", "we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

SharperPage generates an unofficial design mockup and critique of a publicly accessible Shopify product page to illustrate how a redesign might look, and lets you request a quote for production work. Any price or quote presented is a non-binding estimate, not an offer; paid work is governed by a separate written agreement.

2. Eligibility

You must be at least 16 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind it to these Terms.

3. Acceptable use

• Only submit store URLs that are publicly accessible and that you are permitted to analyze.
• Do not use the Service for any unlawful, infringing, deceptive, or abusive purpose.
• Do not attempt to overload, disrupt, scrape, reverse engineer, or circumvent rate limits or security of the Service.
• Do not submit content or instructions intended to manipulate or exploit the Service or its AI components.

4. Mockups & intellectual property

Mockups are unofficial demonstrations generated from publicly available content and are not affiliated with, authorized by, or endorsed by any store or brand shown. Product names, images, logos, and copy that appear in a mockup remain the property of their respective owners. Rights holders may request removal at any time via our takedown policy.

The Service, including our software, templates, and design system, is owned by us and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to view mockups we generate for you; we retain all other rights.

5. Third-party services

The Service relies on and interoperates with third parties (including Shopify storefronts and Anthropic's AI). We are not affiliated with or endorsed by Shopify. Your use of any third-party service is subject to that party's terms, and we are not responsible for third-party content or services.

6. No warranty

The Service, mockups, and critiques are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or any guarantee of conversion impact, results, or uninterrupted availability.

7. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed USD $100.

8. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your violation of these Terms, or your submission of any URL or content you were not authorized to submit.

9. Suspension & termination

We may suspend or terminate access to the Service at any time, including for violation of these Terms or to protect the Service or others.

10. Changes

We may update these Terms from time to time; continued use after changes constitutes acceptance. We will revise the "Last updated" date above when we do.

11. Governing law

These Terms are governed by the laws of Pennsylvania, without regard to conflict-of-laws rules, and you consent to the exclusive jurisdiction of its courts.
